These Terms of Service ("Terms") govern access to and use of the website pinksmotorsalesrental.com and the services offered by Pink's Motor Sales & Rental ("Company," "we," "us," or "our"), including vehicle sales inquiries, vehicle sourcing assistance, financing guidance, and vehicle rental services in Jamaica. By accessing the website, requesting services, reserving a vehicle, submitting information, or entering into a rental or sales transaction, the user or customer agrees to be bound by these Terms.

All prices, rates, listings, examples, and vehicle availability shown on the website are subject to change without notice unless confirmed in a signed agreement or written booking confirmation. Sample rental rates currently advertised include compact cars starting around JMD $7,500 to $9,000 per day and 7-seater vehicles starting around JMD $11,500 per day, but final pricing may vary based on season, duration, availability, delivery arrangements, insurance considerations, and vehicle category.

Quotes are invitations to treat and do not create a binding contract until the Company accepts the booking, sale, or transaction in writing or by execution of a formal agreement.

5. Vehicle Sales Terms

Vehicle sale listings, descriptions, photographs, mileage, features, and specifications are provided for general informational purposes and may contain typographical errors, omissions, prior sale issues, or changes not yet reflected online. Customers are responsible for independently confirming vehicle condition, title-related matters, import status, registration, taxes, transfer requirements, and suitability before purchase.

Unless expressly stated in a separate written agreement, financing guidance provided by the Company is general information only and does not constitute legal, tax, accounting, credit, investment, or personalized financial advice.

Vehicles sold on the website or through the Company's sales channels may be offered subject to availability, prior sale, inspection, payment clearance, and completion of required transfer documentation.

6. Booking and Reservation Terms

A rental request is not guaranteed until the Company confirms the booking. The Company may require:

7. Rental Period and Return

Rental periods are calculated according to the dates and times stated in the booking confirmation or rental agreement. Vehicles must be returned on time and in substantially the same condition as received, ordinary wear and tear excepted.

Fuel must be returned at the agreed level. If a vehicle is returned late, excessively dirty, damaged, without agreed fuel level, or without keys, documents, accessories, or equipment provided by the Company, additional charges may apply.

8. Driver Obligations

The renter and any approved additional driver must:

Jamaica's Road Traffic Act, 2018 and related regulations govern licensing, insurance, and road conduct in Jamaica, and offences may attract substantial fines and other penalties.

9. Traffic Tickets and Violations

The renter is solely responsible for all traffic tickets, parking tickets, camera violations, toll charges, fines, penalties, impound costs, court costs, and related administrative expenses incurred during the rental period or arising from the renter's use or possession of the vehicle. The Company may charge the customer for such amounts, provide renter details to the relevant authority, and recover related administrative costs to the extent permitted by law.

10. Additional Drivers

Additional drivers are permitted only if expressly approved by the Company in advance. Each additional driver must satisfy the same identification, age, licensing, and eligibility standards as the primary renter, and the primary renter remains jointly responsible for the acts and omissions of each approved additional driver.

11. Delivery and Collection

Airport, hotel, and islandwide delivery or collection may be available by arrangement and may be subject to additional charges, route limitations, staff availability, safety considerations, and timing restrictions. The customer is responsible for being present at the agreed location and time with the required documents.

The Company may reschedule delivery or collection due to weather, safety concerns, force majeure, access issues, flight changes, operational constraints, or events outside its reasonable control.

12. Deposits, Payments, and Charges

The customer authorizes the Company to charge amounts due under the agreement, including rental fees, extensions, late return charges, fuel adjustments, cleaning charges, traffic-related costs, damage-related sums, towing, missing items, administrative fees, and any taxes or statutory fees that apply. A security deposit may be preauthorized, held, or collected and later applied against outstanding amounts.

Refunds, if any, will be processed within a reasonable period using the original payment method where practicable, less any sums lawfully due.

13. Cancellations and No-Shows

Cancellation and no-show rules may vary by booking type, season, vehicle category, and payment method. Unless a separate written cancellation policy is provided at booking, reservation payments may be non-refundable in whole or in part where the Company has reserved inventory, declined other bookings, incurred delivery costs, or suffered loss due to late cancellation or non-appearance.

14. Vehicle Condition and Maintenance

The Company aims to provide well-maintained and insured vehicles, but the customer must inspect the vehicle at handover and promptly note any visible damage, defects, fuel level, accessories, and condition issues. Continued use of the vehicle after handover is treated as acceptance of the vehicle condition except for defects properly reported.

The renter must not perform repairs or permit repairs without the Company's prior approval, except where immediate action is reasonably necessary to prevent greater damage or respond to an emergency.

15. Accidents, Damage, Theft, and Insurance

In the event of an accident, theft, vandalism, seizure, or damage, the renter must immediately notify the Company and, where appropriate, the police and insurer. The renter must cooperate fully with incident reporting, evidence preservation, statements, insurance claims, and recovery procedures.

The renter may be responsible, to the extent permitted by law and the applicable rental agreement, for loss, damage, excess, negligence, prohibited use, uninsured loss, or charges not covered by insurance.

16. Consumer Rights

Nothing in these Terms is intended to exclude or unlawfully limit rights that consumers may have under Jamaican law. Jamaica's Consumer Protection Act is intended to promote and protect consumer interests in relation to the supply of goods and provision of services and supports the protection of life, health, and safety of consumers and others.

17. Intellectual Property

The website, business name, logos, branding, text, graphics, photographs, layouts, and other content are owned by or licensed to the Company unless otherwise stated. No right, title, or interest is transferred to any user except the limited right to access the website for personal, non-commercial use in accordance with these Terms.

18. Disclaimers

The website and its content are provided on an "as is" and "as available" basis to the fullest extent permitted by law. While the Company seeks to keep information accurate and current, it does not warrant that the website will always be uninterrupted, error-free, secure, complete, or suitable for a particular purpose.

19. Limitation of Liability

To the fullest extent permitted by law, the Company is not liable for indirect, incidental, special, consequential, or punitive losses, including loss of profits, loss of business, missed travel plans, or loss of data, arising from use of the website or services. Nothing in these Terms limits liability where such limitation is prohibited by applicable law, including liability that cannot lawfully be excluded for fraud, wilful misconduct, or certain statutory obligations.

20. Indemnity

The customer agrees to indemnify and hold harmless the Company, its owners, employees, contractors, and agents from claims, losses, liabilities, costs, and expenses arising out of the customer's breach of these Terms, unlawful conduct, negligent acts, misuse of a vehicle, or violation of any applicable law or third-party right, to the extent permitted by law.

21. Privacy

Use of the website and services is also governed by the Company's Privacy Policy. Jamaica's Data Protection Act, 2020 establishes a framework for lawful processing of personal data and grants rights to data subjects, including access and rectification rights.

22. Suspension and Termination

The Company may suspend, refuse, or terminate access to the website, a booking, a reservation, or a rental agreement immediately if it reasonably believes there has been fraud, unauthorized driving, unsafe use, threatened non-payment, false documentation, breach of these Terms, legal non-compliance, or risk to the vehicle, staff, or public.

Termination does not affect accrued rights, payment obligations, claims, or provisions intended to survive termination.

23. Governing Law and Disputes

These Terms are governed by the laws of Jamaica. Any dispute arising from the website, services, or these Terms shall be subject to the jurisdiction of the courts of Jamaica, unless another mandatory forum applies under applicable law.

Customers are encouraged to raise complaints directly with the Company first so that operational issues can be reviewed promptly. Consumers may also have the option of contacting the Consumer Affairs Commission or the Office of the Information Commissioner where the subject matter falls within those bodies' remit.

24. Changes to Terms

The Company may revise these Terms from time to time by posting an updated version on the website. The updated Terms take effect on the posted effective date unless otherwise stated.
